NEXT4 is concerned about the protection and confidentiality of personal data and is committed to ensuring the best level of protection for your Personal Data in compliance with the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (« GDPR ») and applicable laws on data privacy protection and data security, and with the Data Protection Act of 6 January 1978.

This privacy policy describes what types of information we gather and track when you use our services, how this information is used, and with whom it is shared (« Privacy Policy »).

The most recent version of the Privacy Policy can be consulted on a page published in NEXT4’s official website. 

We may amend this Privacy Policy from time to time to ensure transparency on all processing operations relating to you and your Personal Data in real-time. If NEXT4 wishes to use Customer Personal Data in a manner different from that stated in the Privacy Policy in effect at the time of collection, such changes will be published in a new version of the Privacy Policy.

For your information, undefined capitalized terms have the meaning defined by the GDPR and any applicable laws on data privacy protection and data security.

 

1: Responsibility for data handling

All Personal Data processing is carried out under the responsibility of NEXT4, 3 avenue Didier Daurat – 31400 Toulouse, France, S.A.S. with a capital of 62 500,00 € registered under the number 838 230 340 at the Trade and Companies Registry (RCS) of Toulouse. 

 

2: Purpose of the processing, legitimate basis, recipients and retention period for which Personal Data stored

We collect and process information relating to you and your use of the services for the following purposes, legal basis and retention period:

NEXT4’s legitimate interest, in particular finding new business partners. In this case, your data are collected from sources accessible to public.

3 years after our last contact and 3 years after termination of the contract if you are a customer.

 

3: Use of sub-processors for the processing of Personal Data

Your Personal Data may also be disclosed to services providers to the purpose of communication and prospecting. In doing so, NEXT4 requires its services providers to ensure confidentiality and data protection measure and to respect the existing law and regulation.

NEXT4 may share your Personal Data with companies, organizations, or other entities that perform services on our behalf, such as website support providers. In each case, such third parties are required to use adequate privacy protections and may use the information only for the purpose of providing services to NEXT4.

NEXT4 may disclose Personal Data supplied by you online if necessary to comply with the law or/ regulatory requirements, or to comply with a decision of a competent regulatory or judicial authority.

NEXT4 will not sell your personal information to, or in any way share it with, a third party without your permission, except as provided in this Privacy Policy or when we are required to do so by law.

 

4: Data Transfers

Your Personal Data ara not subject to any transfers outside of European Union. Our services providers are currently located in European Union.
In the event that in the future your Personal Data may be transfer to services providers located outside of European Union and in a country that does provide an adequate protection of personal data, NEXT4 requires from those services providers to ensure data protection and confidentiality, by:
the respect of binding corporate rules in accordance with Article 47 of GDPR;
the signature of standard data protection clauses in accordance with Article 93 of GDPR or a processing contract of data protection in accordance with Article 28 of GDPR and with last version of standard contractual clauses of the European Commission.

 

5: Your rights

You have a right of access, rectification, erasure, opposition and a right to portability (to request a copy of your Personal Data in a structured and machine-readable format) about all your Personal Data.

You also have a right to limit the processing of your Personal Data. If you have consented to the processing of Personal Data, you may withdraw your consent at any time.

You also have the right to define directives concerning the fate of your Personal Data in case of death (for example: retention period, erasure) and to amend them at any time.
You have the right to file a complaint with the supervisory authority or to get compensation from the competent courts.

 

6: Security

NEXT4 has implemented technical, contractual, administrative, and physical security appropriates precautions to protect the confidentiality, integrity, and security of your personal information against accidental or unlawful destruction, loss, or alteration and against unauthorized disclosure or access.
